By accessing or using MP4.Software (the "Service"), including any free or paid premium features, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

1. Acceptable Use

• You are solely responsible for ensuring you have the legal right to download or convert any content you submit to the Service.
• The Service is intended for personal, non-commercial use only.
• You agree not to use the Service in violation of any applicable law or third-party terms, including YouTube's Terms of Service.
• We may suspend or terminate access for any user who misuses the Service or violates these terms.

2. Service Availability, Maintenance & Downtime

You acknowledge and accept that the Service may experience downtime, interruptions, slowdowns, errors, or temporary unavailability. The Service relies on a complex backend stack including third-party tooling, video sources, network infrastructure, and storage systems, any of which may fail, change, or become unavailable without notice.

• The Service is provided without any guarantee of uptime, availability, or uninterrupted access.
• We may perform scheduled or unscheduled maintenance, updates, or changes at any time, which may temporarily render the Service unavailable.
• Conversions may fail, be delayed, or produce unexpected results due to upstream changes (for example, changes by YouTube or other content sources) entirely outside of our control.
• This applies equally to free and paid premium features. Purchasing a premium plan does not entitle you to any service level agreement (SLA), uptime commitment, or guarantee of availability unless explicitly stated in a separate written agreement.
• We are not liable for any loss, inconvenience, or damages resulting from downtime or service interruption.

3. Premium / Paid Features

• Premium features, where offered, are provided on a subscription or one-time payment basis as described at the point of purchase.
• Pricing, features, and availability of premium plans may change at any time. Changes will not retroactively affect an active billing period you have already paid for.
• Refunds, where applicable, are handled at our sole discretion and in accordance with applicable consumer protection laws.
• Downtime, errors, or upstream changes affecting premium features do not, on their own, entitle you to a refund or credit.

4. Disclaimer of Warranties (AS IS / AS AVAILABLE)

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that the Service will meet your requirements, that conversions will be successful, that files will remain available for any specific period, or that any defects will be corrected.

5. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MP4.SOFTWARE, ITS OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF — OR INABILITY TO USE — THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total aggregate liability arising out of or related to the Service shall not exceed the greater of (a) the amount you paid us, if any, in the twelve (12) months preceding the event giving rise to the claim, or (b) USD $10.00. For free users, our total liability shall not exceed USD $0.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

6. Indemnification

You agree to indemnify and hold harmless MP4.Software and its operators from any claims, damages, or expenses arising from your use of the Service or your violation of these terms, including any claims related to content you submit or download through the Service.
